Overview

These Terms & Conditions (the “Terms”) govern your use of the Cremation Air LLC website (the “Site”) and the purchase of services from Cremation Air LLC (“Cremation Air,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms.

Key Definitions

Client: The funeral home, funeral director, or authorized agent placing an order.

Family: The next-of-kin or authorized individual represented by the Client.

Service: Aerial scattering of cremated remains performed by or on behalf of Cremation Air.

Eligibility & Representation

You represent that you are authorized to arrange the Service and that all information provided is accurate and complete.

You agree to comply with all applicable laws and regulations related to the handling and disposition of cremated remains.

Orders & Acceptance

Orders are deemed accepted when we send an order confirmation. We may decline or cancel an order if we cannot complete the Service safely, lawfully, or in accordance with our policies.

Scheduling & Weather

Scattering flights are weather-, safety-, and regulatory-dependent. Estimated dates are targets and may change due to factors beyond our control (weather, airspace restrictions, aircraft maintenance, etc.). If rescheduling is required, we will provide the earliest available alternative.

Chain of Custody & Compliance

Cremation Air maintains documented chain-of-custody procedures from receipt to scattering.

You must follow our packaging, labeling, and documentation requirements. Failure to do so may delay or prevent Service.

Certificates & Photos/Video

When included or purchased, we will provide a Certificate of Aerial Scattering (and any media deliverables) after the Service. Delivery timelines may vary based on operational factors.

Prohibited Content & Conduct

You may not use the Site for unlawful purposes, interfere with security features, or submit unauthorized or harmful content.

Intellectual Property

All content on the Site is owned by Cremation Air or its licensors and is protected by law. You may not copy, modify, or use our IP without permission.

Pricing & Taxes

Prices are in U.S. dollars and subject to change prior to order acceptance. Applicable taxes and fees will be added at checkout.

Disclaimers & Limitation of Liability

Services are provided on an “as-available” basis subject to safety and regulatory constraints. We are not liable for delays caused by weather, ATC, maintenance, carrier delays, or other events outside our control.

To the maximum extent permitted by law, Cremation Air is not liable for indirect, incidental, special, or consequential damages.

Indemnity

You agree to indemnify and hold Cremation Air harmless from claims arising out of (i) your breach of these Terms; (ii) inaccurate authorization or documentation; or (iii) failure to comply with shipping/packaging instructions.

Governing Law & Disputes

These Terms are governed by the laws of [State], without regard to conflicts of law principles.

Disputes shall be resolved in the state or federal courts located in [County, State].

Changes to Terms
